Format of EPR Certificate for Battery Waste

Applicability

Any manufacturer, importer, reconditioner, assembler, dealer, recycler, consumer, and bulk consumer who manufactures, processes, sells, purchases, or uses batteries or their components are subject to the Battery Waste Management Rules 2022 ( Rule 4 (4))The centralized online portal requires individuals and entities involved in the production or manufacture of Batteries to register as “Producers” on Form 1(A).All types of batteries regardless of chemistry, size and shape are covered under the guidelines.

The battery used in equipment relating to the protection of essential security interests, including arms, ammunition, war materials, weapons, and equipment designed specifically for military purposes and equipment designed for space travel, are exempt from these regulations.

Overview - EPR Certificate For Battery in Delhi

A battery waste management rule, 2022, was published on August 22, 2022, replacing the Battery (Management and Handling) Rule, 2001, to ensure that used batteries are managed environmentally.

Batteries of all types are covered by these rules, including batteries for electric vehicles, portable, automotive, and industrial batteries. A battery producer (including importers) has an extended producer responsibility (EPR) to collect and recycle waste batteries and use recovered materials for manufacturing new batteries. EPR prohibits disposal in landfills or incineration of waste batteries and requires their collection and recycling. Waste batteries can be collected, recycled or refurbished by producers themselves or by any other entity to meet the EPR obligations. The rules will establish a centralized online portal and mechanism for exchanging EPR certificates to ensure that producers fulfil their obligations. Responsibilities of Importers, Manufacturers, Producers, Assemblers, and Re-Conditioners

A manufacturer, importer, assembler, and reconditioner must adhere to-

1. Collect used batteries against new batteries sold from original equipment manufacturers and bulk consumers back according to the Schedule.

2. Retain the same type and specifications of new batteries sold as the used batteries collected back.

3. The State Board must receive their Form-I returns every half-year by 30 June and 31 December detailing their sales and buybacks.

4. Collect used batteries at various locations, either individually or jointly, by creating collection centres.

5. Use only registered recyclers to recycle used batteries.

6. Establish safe transportation arrangements between collection centres and registered recyclers with dealers.

7. Ensure that no environmental damage occurs during transportation.

8. Publicize the following through advertisements, publications, posters, or other means:

Lead hazards
Returning used batteries to dealers or designated drop-off locations is the responsibility of the consumer
Dealers and designated collection centres’ addresses

9. Make sure the batteries are marked with the international recycling symbol.

10. Only purchase the recycled lead from registered recyclers.

11. Inform the State Board or the Ministry of Environment and Forests of any violations by dealers.

12. Ensure new batteries should only be sold to registered dealers.

Responsibilities of Recyclers

As a recycler, you must-

If you have not applied for registration already, submit information on Form VI to the Ministry of Environment and Forests or an agency designated by it.
The terms and conditions of registration must be strictly followed; however, those registered with the Ministry of Environment and Forests or other agencies designated by it to reprocess used batteries will also be bound by those terms and conditions.
The State Board must receive annual returns following Form VI.
Ensure that all records are available for inspection by the State Board.
Lead recovered through reprocessing should be marked as ‘Recycled.’
To raise public awareness about lead hazards and the obligation of consumers to return used batteries only to designated collection centres or registered dealers, advocacy, publications, posters, and other methods should be used.

Renewal Process of EPR Battery in Delhi

A renewal application must be submitted in Form 5 at least six months before the expiration date. CPCB officers or agencies designated by the CPCB or the Member Secretary shall evaluate each case’s merits before renewing the recycler’s registration.
